ALLGEMEINE GESCHÄFTSBEDINGUNGEN (AGB)

1. Geltungsbereich

Diese AGB gelten für alle Beratungsleistungen von [VOLLSTÄNDIGER NAME] (im Folgenden: "Anbieterin") gegenüber Klientinnen (im Folgenden: "Klientin").

2. Leistungsumfang

Der genaue Umfang der Leistungen ergibt sich aus dem jeweiligen Angebot und der Auftragsbestätigung. Die Anbieterin behält sich vor, Leistungen nach eigenem Ermessen auszuwählen und anzupassen.

 3. Preise und Zahlung

Alle Preise verstehen sich in Euro (€) und sind Nettopreise. Die Zahlung erfolgt im Voraus nach Rechnungsstellung. Zahlungsziel: 14 Tage ab Rechnungsdatum.

 4. Stornierung und Rücktritt

Bei Stornierung bis 7 Tage vor Beginn: vollständige Rückerstattung.

Bei Stornierung weniger als 7 Tage vor Beginn: 50% der vereinbarten Vergütung werden als Stornogebühr berechnet.

Bei Nichterscheinen ohne Absage: 100% der vereinbarten Vergütung.

5. Vertraulichkeit

Beide Parteien verpflichten sich, alle im Rahmen der Zusammenarbeit erhaltenen vertraulichen Informationen streng vertraulich zu behandeln.

6. Urheberrecht

Alle im Rahmen der Beratung erstellten Materialien (insbesondere Style Decks, Empfehlungen und Konzepte) bleiben geistiges Eigentum der Anbieterin, soweit nicht anders vereinbart. Eine Weitergabe oder Veröffentlichung bedarf der schriftlichen Zustimmung.

7. Haftung

Die Anbieterin haftet nur für Schäden, die auf grobe Fahrlässigkeit oder Vorsatz zurückzuführen sind. Eine Haftung für mittelbare Schäden oder Folgeschäden ist ausgeschlossen.

 8. Anwendbares Recht

Es gilt österreichisches Recht unter Ausschluss des UN-Kaufrechts. Gerichtsstand ist Wien

TERMS & CONDITIONS

 1. Scope

These Terms & Conditions apply to all consulting services provided by Clara Berding (hereinafter: "Consultant") to clients (hereinafter: "Client").

 2. Scope of Services

The exact scope of services is determined by the respective offer and order confirmation. The Consultant reserves the right to select and adapt services at her own discretion.

3. Prices and Payment

All prices are in Euros (€) and are net prices. Payment is due in advance upon invoicing. Payment term: 14 days from invoice date.

 4. Cancellation and Withdrawal

Cancellation up to 7 days before start: full refund.

Cancellation less than 7 days before start: 50% of the agreed fee will be charged as a cancellation fee.

No-show without notice: 100% of the agreed fee.

5. Confidentiality

Both parties agree to treat all confidential information received in the course of the collaboration with strict confidentiality.

6. Intellectual Property

All materials created as part of the consulting (in particular Style Decks, recommendations and concepts) remain the intellectual property of the Consultant unless otherwise agreed. Sharing or publication requires written consent.

 7. Liability

The Consultant is only liable for damages caused by gross negligence or intent. Liability for indirect or consequential damages is excluded.

8. Governing Law

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Vienna..
